1. Acceptance of These Terms
By downloading, accessing, or using the Autism Victory application and the related websites at autismvictory.app and autismvictory.com (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

2. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to use the Service and to purchase a subscription. By using the Service, you confirm that you meet these requirements.

3. What the Service Provides
Autism Victory offers educational content, a bilingual (English and Spanish) library of books and audiobooks, calming audio, and AI-powered tools that help caregivers identify and apply for programs that may be available to them. The Service is designed for parents, caregivers, and families of individuals with autism.

4. Informational Purposes Only — No Professional Advice and No Guarantee
The Service and all of its content are provided for informational and educational purposes only and are not a substitute for professional medical, legal, financial, or other advice. Program and benefit information is general in nature. Eligibility for any program, benefit, or payment depends on your individual circumstances, your state or jurisdiction, and the rules of the administering agency, and it may change over time.

We do not determine eligibility, and we do not guarantee that you will qualify for, receive, or be paid by any program. Words such as “may,” “could,” “might,” and “up to” reflect that outcomes depend on your situation. Always confirm details with the relevant agency or a qualified professional before making decisions.

5. Subscriptions, Free Trial, and Billing
Plans: Autism Victory offers subscriptions at $6.99 per month or $49.99 per year. Prices may change; the current price is always shown at checkout before you are charged.

Free trial: New subscribers may be offered a 5-day free trial. A valid payment method is required to start the trial.

Automatic renewal: Unless you cancel before the trial ends, your paid subscription begins automatically when the 5-day trial ends, and your payment method is charged the applicable fee. Subscriptions then renew automatically at the end of each billing period (monthly or annual) until you cancel, and each renewal charges the then-current fee.

Payment processor: Payments are processed securely through Stripe, and subscription management is supported by RevenueCat. Billing is handled through your Autism Victory account on the web — not through the Apple App Store or Google Play.

How to cancel: You may cancel at any time through your account billing portal or by emailing support@autismvictory.app. To avoid a charge, cancel before your free trial ends or before your next renewal date. Cancellation stops future charges; you keep access until the end of your current billing period.

6. Refunds
Except where required by law, subscription fees are non-refundable and partial billing periods are not prorated. If you believe you were charged in error, contact support@autismvictory.app and we will review your request.

7. Acceptable Use
You agree not to misuse the Service, including by attempting to access it unlawfully, interfering with its operation, reverse-engineering it, reselling or sharing access, or using it to violate any law or the rights of others.

8. Intellectual Property
All content in the Service — including text, images, graphics, logos, audio, and software — is owned by Autism Victory or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable, non-commercial license to use the Service. You may not copy, distribute, modify, or create derivative works from our materials without our prior written consent.

9. Third-Party Services
The Service depends on third-party providers (such as Stripe, RevenueCat, and our AI provider) and may link to third-party websites. We are not responsible for the content, policies, or practices of third-party services.

10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that AI-generated content will be accurate or complete.

11. Limitation of Liability
To the maximum extent permitted by law, Autism Victory will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or data, arising out of or relating to your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim arose.

12. Indemnification
You agree to indemnify and hold harmless Autism Victory and its owners, employees, and partners from any claims, damages, or expenses arising out of your misuse of the Service or your violation of these Terms.

13. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to their jurisdiction.

14. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted with a new Effective Date. Your continued use of the Service after changes are posted means you accept the updated Terms.
